Information received through www.domesticpreparedness.com and its associated DPJ weekly may be displayed, reformatted and printed for your personal, non-commercial use only. You agree not to reproduce, re-transmit, distribute, disseminate, sell, publish, broadcast or circulate the information received through www.domesticprepraredness.com and DPJ Weekly to anyone, including but not limited to others in the same company or organization, without the expressed prior written consent of the Texas Division of Emergency Management, with these exceptions:

5. INFORMATION YOU PROVIDE:

You agree that you may upload to the software files, message boards, or otherwise transmit on or to WWW.DOMESTICPREPAREDNESS.COM only such information, images, software, or files. (Content) that you represent and warrant (1) is not subject to any copyright or other rights, or (2) any holder of rights has given express authorization to do so. By submitting Content to the Texas Division of Emergency Management , Inc. for posting on WWW.DOMESTICPREPAREDNESS.COM you grant the Texas Division of Emergency Management and The Texas A&M University System and its affiliates a paid-up, worldwide, royalty-free, perpetual, irrevocable, non-exclusive right (including any moral rights) and license to use, re-use, re-produce, modify, edit, adapt, publish, re-publish, translate, create derivative works from, distribute, communicate to the public, perform and display the Content (in whole or in part) worldwide and/or to incorporate it in other works in any form, media or technology now known or later developed (including but not limited to electronic databases), for the full term of any rights that may exist in such Content collectively referred to as “Rights”. You also warrant that the holder of any Rights, including moral rights in such Content, has completely and effectively waived all such Rights and validly and irrevocable granted to you the display, view, store, and reproduce the Content for personal use. Subject to the foregoing, the owner of Content placed on WWW.DOMESTICPREPAREDNESS.COM retains any and all Rights that may exist in such Content.

6. CONDUCT AND COMMUNICATION

You also recognize that communication over WWW.DOMESTICPREPAREDNESS.COM often occurs in real time or is posted on one of the WWW.DOMESTICPREPAREDNESS.COM message boards or libraries. You acknowledge that the Texas Division of Emergency Management and The Texas A&M University System cannot, and does not intend to, screen communication in advance for accuracy or conformance to standards of non-abusive non-profane discourse, or any laws. However, the Texas Division of Emergency Management and The Texas A&M University System may elect, at its sole discretion, to monitor some, all, or none of public areas for adherence to its rules for non-abusive, non-profane language. Accordingly, you acknowledge that the Texas Division of Emergency Management and The Texas A&M University System shall not assume nor have any liability for any action or inaction by the Texas Division of Emergency Management and The Texas A&M University System, Inc. with respect to Content on WWW.DOMESTICPREPAREDNESS.COM Any conduct by a Member that in the Texas Division of Emergency Management and The Texas A&M University System’s sole discretion restricts or inhibits any other Member, person, or entity from using or enjoying WWW.DOMESTICPREPAREDNESS.COM or another service shall entitle the Texas Division of Emergency Management and The Texas A&M University System to immediately terminate membership without notice. You agree to use WWW.DOMESTICPREPAREDNESS.COM only for lawful purposes. You may not use, or allow others to use, your account, either directly or indirectly, to:

(a) transmit any unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, hateful, racially, ethnically or otherwise objectionable Content;

(b) harass, threaten, embarrass, or cause distress, unwanted attention or discomfort upon another Subscirber or user of WWW.DOMESTICPREPAREDNESS.COM, Inc. or other person or entity;

(c) post, transmit, promote, link, or facilitate the distribution of sexually explicit or other Content which is deemed by the Texas Division of Emergency Management and The Texas A&M University System to be offensive;

(d) disrupt the normal flow of dialogue in a chat room or otherwise act in a manner that negatively affects other Subscribers, users, individuals, or entities, such as causing the screen to “scroll” faster than other members or users are able to type to it or any action to a similar disruptive effect;

(e) impersonate any person or entity, including, but not limited to a Texas Division of Emergency Management or The Texas A&M University System official or a chat or forum leader, guide or host, or communicate under a false name or a name that you are not entitled or authorized to use;

(f) post or transmit, or cause to be posted or transmitted chain letters or pyramid schemes;

(g) post or transmit, or cause to be posted or transmitted any unsolicited advertising, promotional materials, or other forms of solicitation to other Subscribers, individuals, or entities, except in those areas that are expressly designated for such a purpose (e.g. the classified area), or collect or harvest screen names of other Members without permission;

(h) post or transmit, or cause to be posted or transmitted any communication or solicitation designed or intended to obtain password, account, or private financial information from any Member;

(i) violate any operating rule, policy or guideline of any other interactive service, including, but not limited to the operating policies of the International Areas; or

(j) intentionally or unintentionally violate any applicable local, state, national, international, or foreign law, including, but not limited to any rules or regulations having the force of law.

7. NO EXPORTING OF SOFTWARE TO CERTAIN COUNTRIES

You agree to abide by U.S. and other applicable export control laws and not to transfer, by electronic transmission or otherwise, any Content subject to restrictions under such laws to a national destination prohibited under such laws, without first obtaining, and then complying with any requisite government authorization. You further agree not to upload to www.domesticpreparedness.com any data or software that cannot be exported without prior written government authorization, including, but not limited to certain types of encryption software. This assurance and commitment shall survive termination of this agreement. Control laws also prohibit nationals of Cuba, Iran, Iraq, Libya, North Korea, Sudan and Syria from gaining access to certain Content or software of the Texas Division of Emergency Management or The Texas A&M University System.

This Agreement is personal to you, and you may not assign your rights or obligations to anyone. If any provision in this Agreement is invalid or unenforceable under applicable law, the remaining provisions will continue in full force and effect. This Agreement, your rights and obligations, and all actions contemplated by this Agreement shall be governed by the laws of the United States of America and the state of Texas, as if the Agreement was a contract wholly entered into and wholly performed within the state of Texas. This Agreement will not be governed by the Unites Nations Convention on Contracts for the International Sale of Goods.
